The entirety of the present General Terms and Conditions shall have exclusive applicability to the operations, services and/or agreements as between the Begijnhof Hotel and the customer, to the exclusion of any other General Terms and Conditions to which reference may be made by the customer. Deviations from the content and/or application of the present General Terms and Conditions shall only be accepted if the same have been expressly agreed in writing. A deviation or the invalidity in respect of any of the provisions of the present General Terms and Conditions shall not affect the application of the other provisions.
All reservations must be requested and confirmed in writing. In addition, each reservation shall be invoiced at the prices and terms and conditions that may be in force on the date of confirmation of the reservation in question. All prices are inclusive of VAT and other taxes and are payable in Euros. The price may be unilaterally revised, depending on governmental measures, including changes in duties and taxes. Group rates shall only apply in case of simultaneous booking of a minimum of 10 rooms. If this number is not achieved on the day of arrival, the standard room rates as applicable at that time shall apply unchanged.
PAYMENT TERMS AND CONDITIONS
All invoices shall be paid within 15 days after the invoice date. Protests in respect of invoices shall be lodged through registered letter within 8 days after the invoice date. If not, the invoice shall be deemed to have been accepted. In case of late payment, a late payment of 1% per month shall be charged, counting from the date of the invoice, through operation of law and without the need to issue a prior notice of default. In such case, liquidated damages equal to 10% of the invoice amount shall be payable, subject to a minimum of €100, through operation of law and without the need to issue a prior notice of default.In case of delay in payment, the Begijnhof Hotel reserves to itself the right to terminate all the agreements that are still to be executed, and to stop the execution of ongoing agreements, with immediate effect and without the need to issue a prior notice of default.
Reservations shall be requested in writing or via the website, and shall only be binding after express written confirmation by the Begijnhof Hotel. Begijnhof Hotel reserves the right, at the time of reservation, to demand the full amount payable for the reserved services, or to request a credit card guarantee, the validity of which can be checked; the credit card must be issued in the personal name of the customer or the legal entity that he legally represents.
CANCELLATION TERMS AND CONDITIONS
Each reservation has always to be requested in writing. A reservation may be cancelled by individual customers up to 24 hours prior to the day of arrival. In case of cancellation between 24:00 hrs prior to the day of arrival and 16:00 hrs on the day of arrival, 50% of the room rate of the first overnight stay shall be charged. In case of cancellation after 16:00 hrs on the day of arrival or in case of a no show, 100% of the room rate of the first overnight stay shall be charged. In such case, the Begijnhof Hotel reserves the right to regard the agreement as terminated by operation of law and without the need to issue a prior notice of default.
For group reservations, which shall mean booking of 10 rooms or more, the following cancellation charges shall be invoiced in case of a partial or full cancellation of the number of persons: Cancellation up to one month prior to the day of arrival before the first check-in date: 20% of the full price of the reserved services. Cancellation between 1 month and 16 days prior to check-in date: 50 % of the full price of the reserved services. Cancellation between 15 and 6 days prior to check-in date: 75% of the price of the reserved services. Cancellation between 5 and 0 days prior to check-in date: 100% of the price of the reserved services. Begijnhof Hotel reserves the right to charge these cancellation charges via the specified credit card details. In case of disagreements concerning the aforesaid cancellation information, the management reserves the right to decide unequivocally.
CHECK-IN AND CHECK-OUT
The customer may check-in starting from 14:00 on the day of arrival and should check out before 11:00 hrs on the day of departure. In case of late check-out, the Begijnhof Hotel reserves the right to charge an amount of €30 per hour. Keys should be returned to the reception at the time of check-out. If keys are not returned, an amount of €50 per key shall be invoiced.
Each complaint relating to the services and/or goods supplied by the Begijnhof Hotel shall be notified immediately during the stay at Begijnhof Hotel, or after such stay, by registered letter, within three working days following the departure of the customer. Failing this, the Begijnhof Hotel shall regard its services as having been accepted.
None of the parties shall be liable for delay or shortcoming in the fulfilment of the obligations of this contract if such delay or shortcoming occurs due to force majeure. Force majeure shall mean all events beyond the control of the parties such as, among others, but not limited to: coercive government measures, fire, natural disasters, war, strikes, lockout, blockage of communication media and/or data flows, etc.
LIABILITY OF THE BEGIJNHOF HOTEL
The Begijnhof Hotel is bound to provide the services specified in the reservation confirmation to the customer. The descriptions, sizes, colours and the photos and drawings in the price lists, catalogues and/or website are only for information. If it is not possible for Begijnhof Hotel to provide the customer with the accommodation specified in the reservation confirmation, the Begijnhof Hotel shall have the right to provide the customer with alternative accommodation of the same category, or of the category that is available at that point in time. In this connection, the Begijnhof Hotel shall bear the additional costs if any, of the same. The Begijnhof Hotel is not liable for accidents if any that may occur on the premises of the hotel, including the parking area. The Begijnhof Hotel is not liable for loss, theft or damage caused by third parties to the customer, except the articles for which an express and written custody agreement was concluded.
LIABILITY OF THE CUSTOMER
The Customer is liable to the Begijnhof Hotel for all the damage that he or persons accompanying him or to whom he provides accommodation in the buildings of the Begijnhof Hotel or in the internal or external appurtenances thereof, to the goods that form part of the hotel furnishings, or that belong to its personnel or to third parties. Prior to his departure, the customer shall immediately compensate the Begijnhof Hotel in all respects for any damage that he causes to the moveable and immovable property of the Begijnhof Hotel, on the simple request of the Begijnhof Hotel.
Both the public as well as private areas of the Begijnhof Hotel are non-smoking areas. If the customer and/or persons accompanying him or to whom he has provided accommodation violates this condition, the customer shall be liable to pay damage compensation of €150. The Begijnhof Hotel reserves to itself the right to suspend the fulfilment of its obligations and to regard the agreement terminated by operation of law and without the need for prior notice of termination, if the customer violates this provision.
JURISDICTION AND APPLICABLE LAW
All disputes that may arise under the General Terms and Conditions shall be exclusively subject to Belgian law and to the jurisdiction of the Court of Leuven, being the Commercial Court or the Court of First Instance and Justice of the Peace of the First District of Leuven.
READ AND ACCEPT
The customer declares that he has taken full cognisance of these General Terms and Conditions, and of the terms and conditions, documents and annexes to which the same refer, and that he accepts the same at the latest by the time of reservation.
